In detail

An initial consultation lasting up to one hour costs EUR 220.00 if you book by telephone or e-mail. You enjoy full flexibility and can reschedule or cancel your appointment free of charge up to 24 hours in advance.

If you book and pay for your initial consultation online, you will benefit from a non-refundable, reduced price of EUR 199.00 for up to one hour. Of course, you can postpone your initial consultation in the event of illness or another important reason, but cancelling without good reason will incur costs.

We will discuss the most suitable billing method for all further services that we provide to you at the end of the initial consultation, when we have sufficient knowledge of the problem and your wishes and objectives. In general, the following types of billing by Austrian lawyers exist:

Hourly rate

In many parts of the legal profession, billing according to hourly rates has become established. In this case, an appropriate hourly rate is agreed and charged for the actual time spent on our work. You can see the services we provide on the basis of a detailed list.

The actual hourly rate depends primarily on the subject matter, complexity and urgency of your case. The statista.de platform provides an overview of the usual hourly rates for medium-sized German law firms in various sectors - those of Austrian lawyers are comparable.

The main advantage of hourly rate billing is the high transparency of the billing. In addition, the hourly rate is characterised by the fact that all of the lawyer's services - whether meetings, letters or negotiations - are valued equally. This is not the case when billing according to the Lawyers' Tariff Act.

Flat fee

If the work involved can be estimated well in advance, it is possible to agree a flat fee. This is often the case for property transactions or other contractual matters.

The main advantage of a flat fee is that the costs can be planned as accurately as possible for both parties. Conversely, for some of our clients' matters, the amount of work involved can hardly be estimated in advance - for example, if we are to represent you in court proceedings whose duration and scope is unknown to all of us. In this case, a flat fee is not suitable.

Lawyers' Fees Act and General Fee Criteria

If no deviating fee arrangement is made, the legislator provides for a system of lawyers' fees. Corresponding regulations can be found in the Lawyers' Fees Act (RATG), in the General Fee Criteria (AHK) and in the Notaries' Fees Act (NTG), to which the RATG refers in some cases. Billing by tariff is an easily verifiable billing method that the legislator considers appropriate.

Such tariff-based billing is particularly recommended in court disputes, because in many types of proceedings the winning party has a claim for reimbursement of costs calculated according to the tariff against the losing party. Conversely, the lawyer's tariff is specifically tailored to court representation and sometimes leads to unsatisfactory results for both parties in other matters; in such cases, an hourly rate or flat fee is often more favourable for both parties.

If you have taken out legal expenses insurance, the following applies:

For organisational reasons, we will invoice you directly for the initial consultation and you can submit our fee note to your insurance company, provided your policy includes the necessary legal advice cover. If applicable, this will reimburse the consultation rate agreed with you.

Please take your insurance policy or the latest premium invoice from your insurance company with you to the initial consultation. After the initial consultation, we will be happy to contact your insurance company and clarify whether they will cover the costs of our ongoing work. We co-operate with all common Austrian legal expenses insurance companies.
